Identify the right
Not every disagreement in a criminal case is a Marsy's Law violation. Start with the specific constitutional right and procedural posture.
Who may enforce
The victim, retained attorney, lawful representative, or prosecuting attorney upon request may seek enforcement in the court with jurisdiction.
Counsel's role
Private counsel can assess the issue, communicate with the relevant agency, create a record, and determine whether formal court action is appropriate.
